Terms of Services

Our Privacy Policy explains the measures we take to collect, use, and protect your personal data. We prioritize your confidentiality and are dedicated to ensuring that your information is handled responsibly while delivering our services.

These Terms of Service ("Terms") govern use of the Every Child Matters ABA LLC ("ECM," "we," "our," or "us") website and certain electronic communication services made available by ECM.

By accessing or using the ECM website, you agree to these Terms. Participation in optional SMS/text messaging is subject to the SMS-specific terms below.

About ECM and Website Information

ECM provides Applied Behavior Analysis (ABA) services and related behavioral health support.

The website may provide information about:

ABA services

Referrals

Employment opportunities

Community activities

Organizational information

Forms

Contact methods

Other ECM services and resources

Website content is provided for general informational purposes and may be updated without notice.

No Clinical Relationship Created by Website Use

Visiting the ECM website, submitting a form, sending an email, calling ECM, or sending a text message does not by itself establish a provider-client relationship.

ABA services are subject to ECM's intake, consent, assessment, authorization, clinical, insurance, scheduling, and administrative requirements.

No Emergency Use

Do not use ECM's website, email, SMS/text messaging, voicemail, or routine telephone channels for medical, psychiatric, safety, or life-threatening emergencies.

These channels are not monitored as emergency services and response times are not guaranteed.

Call 911 or seek appropriate emergency assistance when immediate intervention is required.

Electronic Communications

ECM may communicate through:

Telephone calls

SMS/text messaging

Voicemail

Email

CTM

Other ECM-approved systems

These systems may be used for client, family, caregiver, applicant, employee, referral, administrative, and operational communication.

SMS/Text Messaging Program

When an individual provides a mobile telephone number and appropriately consents or otherwise authorizes SMS/text communications, ECM may send text messages related to the individual's relationship with ECM.

Messages may include:

Appointment reminders

Appointment confirmations

Scheduling changes

Cancellations

Service coordination

Intake or referral follow-up

Administrative notices

Requested follow-up

Employment-related messages

Training reminders

Operational communications

Other non-emergency communications reasonably related to ECM services or the individual's established relationship with ECM

Consent to Receive SMS/Text Messages

Where consent is required, consent must be knowingly and voluntarily provided.

Consent to receive optional or marketing SMS messages is not a condition of purchasing or receiving ABA services from ECM.

ECM should not preselect an SMS consent checkbox or require optional SMS consent as a condition of receiving services.

Message Frequency, Charges, STOP, and HELP

Message frequency varies based on scheduling, service, administrative, or employment needs.

Message and data rates may apply based on the recipient's wireless plan.

Reply STOP to opt out of optional SMS messages.

Reply HELP for assistance.

After an opt-out request, ECM may send a final confirmation message.

Opting out of SMS does not necessarily prevent ECM from contacting an individual by another lawful communication method when needed for treatment, scheduling, safety, employment, legal obligations, or other legitimate business purposes.

Privacy and Mobile Information

Use of ECM's website and electronic communications is also subject to ECM's Privacy Policy and, where applicable, ECM's HIPAA Notice of Privacy Practices.

ECM does not sell or rent mobile telephone numbers, SMS opt-in information, or SMS consent information.

Mobile information and SMS consent information will not be shared with third parties or affiliates for their own marketing or promotional purposes.

Sensitive Health Information by Text

Standard SMS/text messaging should generally be limited to routine scheduling, coordination, and administrative communication.

Individuals should avoid sending:

Detailed clinical information

Social Security numbers

Full insurance identifiers

Treatment plans

Passwords

Financial credentials

Other highly sensitive information

by standard SMS unless ECM specifically instructs them to use an approved method.

ECM may redirect sensitive conversations to an approved secure clinical or administrative channel.

Communications With Clients, Families, and Minors

ECM may communicate with clients, parents, guardians, caregivers, or other authorized representatives for legitimate service and administrative purposes.

Because ECM primarily serves children and adolescents, direct electronic communication with a minor should occur only when clinically appropriate, professionally appropriate, legally permitted, and consistent with ECM policy and required parent or guardian involvement.

Communication Records

ECM communication systems may create and maintain business records such as:

Call logs

SMS logs

Voicemail

Date and time

Call duration

Telephone numbers

Message history

Delivery information

Routing data

Other metadata

These records may be retained and reviewed for legitimate business, clinical, supervisory, safety, compliance, quality, investigative, documentation, or legal purposes.

Call Recording, Monitoring, and Transcription

ECM technology may support call recording, monitoring, transcription, or similar functionality.

ECM will use such features only when authorized by ECM and in accordance with applicable law, notice and consent requirements, healthcare privacy obligations, and company policy.

No individual should assume that every call is recorded.

If recording is used and notice or consent is required, ECM will take appropriate steps to provide notice or obtain consent.

Website and Communication Acceptable Use

You may not use ECM's website or communication channels to:

Engage in unlawful, fraudulent, threatening, harassing, abusive, or discriminatory conduct

Impersonate another person

Misrepresent authorization

Attempt unauthorized access to ECM systems or another person's account

Transmit malicious software or harmful code

Interfere with security or system availability

Request or disclose confidential information without authorization

Use ECM communication channels in a manner inconsistent with applicable professional, privacy, or safety requirements

Other technology

Service availability may be affected by wireless carriers, internet service providers, third-party outages, device settings, or other factors outside ECM's control.

Wireless carriers are not responsible for delayed or undelivered messages.

No Guarantee of Immediate Response

ECM does not guarantee immediate delivery, review, or response to website submissions, voicemail, email, or SMS/text messages.

Time-sensitive clinical or scheduling issues should be handled using the communication method directed by ECM.

Emergencies should be directed to emergency services.

Unless otherwise stated, ECM owns or licenses the text, branding, logos, graphics, website design, and other materials appearing on its website.

Such materials may not be reproduced, distributed, modified, or used for commercial purposes without authorization except as permitted by law.

Website Disclaimer

ECM makes reasonable efforts to keep website information accurate and current but does not warrant that all website content will always be complete, current, uninterrupted, or error-free.
